I have been granted permission to trap some local beaver under a nuisance permit and took two beaver at castor mounds immediately befor ice up. Now the ice is about six inches thick and there is only about two feet of water under the ice. I was wondering since I am operating under a nuisance permit would it be legal for me to bust a hole in the lodge and set a 330 at the hole just inside the lodge? Also, NYS does not allow 330's on land..Would this be a land or water set since the trap is not actually in the water (The lodge is in the middle of the pond). The ice is full of air making it very white so I cannot see air bubbles from travel routes etc.. What is your opinion of the effectiveness and legality of the above set?

Even though it is an ADC job, unless it specifically states that you can devaite from the law, you can't. You can still make an effective under ice set either using a baited 330 or a foot trap. If nothing else, they aren't going anywhere and the ice won't stay on the pond forever ;D

I know I have been told while on an ADC permit your allowed to set on the dams (if noted so). BUT I do not believe any permit is going to allow you to disturb the hut. My opinion, look on the permit & if your allowed to set the dams, thats the best choice.

Thanks fellas. I can set the dam. Infact we are able to backhoe the dam out of there and will be doing so shortly. Since ice-up there has been no activity at the dam at all. One otter crossing once and that was it. I have had sets there for nearly two weeks without activity. The huts are a good 150 yards from the dam as well with no push-up between huts and dam. I don't know how far the beaver can travel under the ice but for whatever the reason they are not frequenting the dam. I'll attempt a baited 330 in the morning and give the DEC a call about the hut Q?.

Make a "dam set", Set a 330 on the dam. Break away part of the dam with your hands (enough so there a good flow of water). You can count on those beavers coming to fix the "hole" on the dam. You can count on this set taking beaver !!

Just a suggestion but check what's downstream before you do. I had a call from a landowner who's neighbor was going to remove a dam. I work for a local Soil & Water Conservation District and the neighbor called us in concern. Based on measurements from aerial photos and estimating where the water levels are now on those photos, there's about 12 acre feet of water (3.9 million gallons!) behind the dams.
Less than a mile downstream the creek this drains to hits the lake with $$$ houses all around. And the stream averages about 6' - 10' wide most of the way.
Let's see...3.9 million gallons of water in an 8' channel next to $000,000 houses? Can you say lawsuit? Some of the freakin' landscaping is probably $30,000 alone.
Obiviously this is probably an extreme situation...but just a suggestion before you dig. ;D
BTW, WOW there's got to be a good story behind your handle?

Thanks again guys. Tim, I did tear up some of the dam and set my 330 in the flow and an MB on a drowner right in front of it....No action. There are two huts, one large hut at the shore line and a small hut in the middle of the pond. I took the first two at castor mounds at the shoreside hut...Oh, I failed to mention that these are newly established huts and dam...They showed up in august. I don't think that just two beaver would have built two huts but then again I am no beaver man. Tomorrow I will make the washover at the dams significantly larger and set accordingly. I will use the baited 330 through the ice as well.
AdJim, The handle is a holdover from an icefishing site. Walk-on-water is a term a fishing buddy and I use for early ice.

fyi You might want to check the bottom of the permit as most of the ones I have worked under state that if the trapping is done during open season then all normal reg's must be followed. I would also try the baited sets. Some times you can find their runs by looking for obvious travel routes thought trees and brush if there are any.
