That must be a good dedicated ECO you are working with.One time when I mentioned setting up a camera to one of the Wayne County ECOs he told me I have been watching too much tv and laughed at me for suggesting setting up a camera.

Did the judge put a gag order on ole Bob? Not really any new Details I can report, ............... Yet. No more trap disturbances or theft at the "Bait Trap" Culvert. The alleged Perp's Father has been banging on my door two or three times since the ECO visited him while looking for his son to interrogate him. I have not answered the door as I have been covered with Beaver Blood and Muskrat grease up to the elbows and did not want to alarm him. LOL Plus, his conversations at this point should be with the ECO, rather than myself. He's also tried to wave down New Wave Dave who just flys by him at a high rate of speed. It appears someone is getting a little nervous. Stay tuned. walleyed

Sometimes your the windshield, sometimes your the Bug. The Trail Camera malfunctioned by tipping forward on the day of the Perp's appearance at the culvert. There was some nice wood duck photos on it though. The ECO finally ran down the perp and interrogated him. Got him to admit disturbing the traps. Said he "thought the stabilizing sticks were debris clogging the culvert and he wanted to clear it out." When he "saw that they were holding traps in place, he stopped and got back in his truck". ( This he was doing in the pouring rain.) LOL (Which was right when I came sliding around the corner catching him at the scene.) The ECO couldn't get the perp to admit stealing any of the prior 8 traps (3 160's- 5 330's) and, of course, he also had no hard evidence tying him to this fact anyhow. It gets worse. we were trapping the nuisance beaver for the cottage owner's association on the road right-of-way easement in the culvert. Turns out the swamp on either side of the roadway was privately owned by an absentee-landowner. It was un-posted, and we had permission to trap the road culverts, but not from the adjoining land (swamp)owner. The Perp's father had taken it upon himself to contact the daughter of the apparently deceased landowner, and informed her that we were illegally trapping on (her) land in order to deflect guilt away from his son. He apparently offered to buy the swampland from her. The perp's father then contacted half the ECO's in Jefferson County and tried to get them to press charges against us for illegal trapping and trespassing. All the above ECO's declined and referred the Perp's Father to the original investigating ECO who also declined to acknowledge his demands. The ECO called the property owner and affirmed that she did not want anyone hunting or trapping the swamp. The ECO advised her that we would be notified and our traps would be removed from the culvert. The ECO advised me to remove my traps and I did so immediately. The ECO apologized that because of the culvert camera malfunction, and lack of any real hard evidence proving that the perp stole any traps, plus the fact that we were allegedly set on private property without permission, would make it hard to prosecute the perp for disturbing a ("lawfully set trap") The fact that we had the blessings of the Cottage Owner's Association to trap the private road right-of-way easement mitigated any wrongdoing on our part but would not necessarily extend to us a right for maintaining "lawfully set traps" in the culvert. Very convoluted outcome but in a nutshell: the perp got off without being cited because there was NO hard evidence to tie him to the crime in order to convict him, plus we did not have a completely legitimate, right to have traps "lawfully set" in the culvert. lesson learned, and now the perp and his father has the ECO's undivided attention in the future. thanks for following along on this storyline. walleyed

Congratulations to you and the local ECO on the cooperative way that this incident was handeled.This is the only way that these incidents can be reduced in the long run.If this perp didn't learn from this incident he deserves whatever concequences he incurs the next time.I firmly believe that anyone who steals a couple of hundred dollars worth of traps would not hesitate to break into someones camp or steal from a local landowner.Good job everyoneI think that he had some very tense moments.

I totally understand your situation and have been down that road my self in the pass 37 years of trapping .It is never easy and it is very frustrating hang in there .
