I didn't want to take the season opening post further off topic so I'm starting this one. Scott and Herm to go along with your discussion of putting sets out before opening day I have been told by ECO's that traps placed in the field whether before or after opening of the season and whether set or not must be visited each day under the 24 hr check law. I was also told that a person finding and removing traps placed before the season would not be prosecuted for it. Just a few tidbits for thought and or discussion.

I have been told the same. Along with legally set traps are only those put out after 7am on the opening day. I suppose that Herms literal interpretation of the way the law reads could be argued with good grounds, but I doubt it would hold up. I wonder if a trap staked but not set is "legally set", therefore can not be tampered with. I also wonder how anyone would know if you were checking an unset trap every 24 hours, especially if you checked those at night. How long do you think someone would go by an unset trap before they thought it wasn't being tended?

Seems strange you have to check every 24 hours even if the trap is not set. I work a 24 hour shift, so the day before a shift, I would disable all sets on my line and reset them the morning after.

This is a case where the people who were writing the law did not understand what they were writing. The DEC regulation is writen different than the law.The reg.reads before7:00 on opening day. I was talking to someone years ago who told me that someone reported him for not checking a fox trap for three days.When ever this person went buy the trap they saw a fox.What they did not realize was they had seen three different fox three days in a row in the same trap. Does anyone remember the tread on Trapperman where someone was ticketed in Pa. for not checking traps he had laying outside in his back yard. '
