I was reading about attaching pails to trees with the opening facing up and a 220 in it. With the state regs can this be done under four feet off the ground and baited? Or do I still have to have the trap above the 4' mark. I know a dog will not poke its nose in @ 3 feet.

We were having this same discussion on another thread with wooden boxes. If using 220 size traps, you at least need to be 4 feet up but even then, I wouldn't do it because in my opinion, you could still be ticketed because the regulation states when using a box that the opening can only face down and be no higher than 6" from the ground. Common sense tells you that you won't catch a hound 4 feet in the air but common sense also tells you many other regulations don't makes sense.....

I think so long as the box is more than 4 feet up, you're still okay. the "hole down, 6 inch rule" is so that people don't hang the boxes low enough for for a dog to get into. BUT.. I would agree that it may depend on the ECO that sees your trap. I'd call your local ECO. I'm going to so that I know the answer to this one because I want to put buckets on trees for fisher. When I get a response, I'll post the answer.

You can place bucket/pail sets onto trees. They must be 4' off the ground. The syllabus does not indicate it, but it is legal. In another forum/page this was answered via a letter from DEC. However, the bait must be covered so as to prevent birds of prey from unwanted catches. Easiest is to place hole towards ground.
