Hi everyone, I am a new trapper and have a question concerning dam break sets. Most of my sets have been for beaver in unit 5J (Northern Zone). Connected on a beaver on the last night of my first season and now I am hooked. It is my understanding that disturbing the dam in any fashion is illegal however I have come across a Youtube video (link below) of a nuisance trapper using a dam break set. I have called DEC to ask a few questions already but am not looking to draw too much attention to myself or the areas I trap in. Any help greatly appreciated. Clarify what your asking. You can not disturb a beaver lodge,dam, or house. You can not set within 5 feet of rat house or 15 feet from dam, house, or lodges. However… during otter season you can set a legal trap within 15 feet of dam, but, not house or den. Believe me, DEC will steer you in the right direction if you ask them questions.

Trapperjack is correct. Since the otter season runs the same time as beaver season in the northern WMU's you can set on or within 15 feet of a beaver dam, however you can not make a break in the dam.That might be legal in other states, but not in New York. I think what he is asking is since the law says you cannot disturb a beaver dam or set for beaver within 15 ft, why is a nuisance trapper in the Dacks doing just that on youtube. The answer is that the nuisance permit issued by the DEC may allow romoval of the dam or other beaver materials as well as allow disturbance of the dam. So unless you're operating under a nuisance permit you must follow state guidelines.

trapperjack, paintedpaw, and trappermac - thank you for your responses. Trappermac summed it up the best - guess I did not understand the difference between the rights of nuisance permit holders and regular trapping permit holders. Also did not understand how or why you would trap on/or within 15 feet of a dam for beaver unless you were able to disturb the dam. Also, what is considered disturbing a dam? Can i push a stick into the dam that has lure on it or is this the same as disturbing a dam? Thanks again - posts aren't meant to anger anyone, just looking for guidance.

I believe for the most part that disturbing a dam means ripping a hole in the dam or spillway or digging out a trap bed. I would think pushing a lure stick into the dam would be legal.
