The regulations put a size limit on traps placed on beaver dams when otter season is closed. Because I trap in the northern zone were beaver and otter season run at the same time this has never bothered me.
Now I have a damage control job to do by permit. So it now matters. Were does the dam the beaver are building to plug the culvert stop and the ditch bank start?
Would the dam be just the mud sticks and debris the beaver have placed ?
The rest even if it does contain water flow would be ditch bank.
Please correct me if I am wrong.

The beaver dam is the structure built by the beavers, simple as that. The ditch bank was not constructed by beavers ;D Also, under proper DEC issued nuisance beaver permits, many of the regulations we have to abide by while fur trapping are no longer applicable.
