The state has made the first arrest on the safe act according to the news a man was arrested for selling an illegal gun and three hundred rounds of ammunition.No names or details released.

Upstate man is 1st arrested under NY's SAFE Act Updated: Friday, March 15 2013, 08:35 AM EDT HANOVER (AP) -- Authorities say a western New York man apparently is the first person to be charged with violating the state's gun-control law. Local media outlets report that state Attorney General Eric Schneiderman says 32-year-old of Silver Creek was charged Thursday with felonies related to the sale of illegal weapons. Schneiderman says he twice sold weapons that are prohibited under the New York Secure Ammunition and Firearms Enforcement Act, passed by the Legislature in mid-January. Officials say the violations occurred later that month and again in February in the Chautauqua County town of Hanover, 30 miles southwest of Buffalo. Prosecutors say the sales involved two semi-automatic rifles and more than 300 rounds of ammunition. Wassell was released on his own recognizance. Prosecutors said he didn't have an attorney. A Chautauqua County man who sold two assault weapons to an undercover police investigator has become the state’s first arrest for a violation of the NY SAFE Act. Benjamin M. Wassell, 32, of Hanover, allegedly sold the illegal firearms in January and February, after the gun law banning assault weapons went into effect.
“The defendant is accused of illegally selling assault weapons not once, but twice. Add to that, he was willing to sell to someone without knowing anything about their background, and it’s exactly the type of dangerous and illegal activity that can lead to more gun violence in our communities,” State Police Superintendent Joseph D’Amico said in a statement Thursday. Wassell is accused of selling a DelTon DTI-15 assault rifle outfitted with a pistol grip, a telescoping butt stock and a bayonet mount, as well as a Armalite AR-10 Magnum semiautomatic rifle. The criminal sale of an illegal weapon is a class D felony. He was arraigned Thursday in the Town of Hanover Court and has been released upon his own recognizance. He will return to court March 20, where he will be represented by a public defender, according to the attorney general’s office.

...and they will surely use this to set a precidence and throw the book at this guy and "parade" this/him like some trophy catch, (public defender my @ss, how about a puppet of the completely corrupt NY legal system) while drug dealers are slapped on the wrist daily and sent on their merry way to continue their illegal activities; unfortunately (with all sincerity) my days as a NY resident are numbered!!! maybe the virginia's and carolina's are onto something (north carolina, south carolina.....virginia, west virginia....how about a similiar scenario for NY?!?!?!)

He sold the second one after the buyer told him that he was a convicted Felon... This would have been illegal even before the SAFE act... This guy was just plain stupid!!!

This is exactly the kind of stupidity we don't need right now.No brains, no common sense and jail don't scare them either horsewhipping is about all that is left.They should have been brought up by my Grandmother and they would have learned right from wrong.

If some one owns a AR15 that's ok but the gun can't be sold prIvetly to another hunter ? But stock being fixed solid,5 round mag ? If its ok to have one but it can't ever be sold or handed down to a friend of family member how is it ok to orb one in the first place

This from the safe act web page. Q: What family members are exempt from the private sale/transfer provision? A: Sales or transfers to and between spouses, domestic partners, children and step-children, are exempt from the private sale/transfer provision.
