Yes it was dead when I got there.Caught it in 160 conibear in a cubby next to small stream.

Body traps on land are not legal at this point in time. my opinion that fisher could warrent a ticket.

If the 160 is not baited it can be set in a blind cubby. If baited it must be set according to the regulations for baited coni's over 5.5 inches. He is in the Southern Zone, he's OK provided he follows the regs. In the Northern zone you can't set a "baited" coni on land after Dec 10th (?).... believe that is the way the regs read.

He is from the Southern zone.
Assuming that DEC requested that he take possession of the non-target during their closed season... he certainly could have set the trap legally.
In the Southern zones, we ARE allowed to use coni's with bait through the entire season.
And a 160 or 220 can both be used in cubbies legally if you abide by the regulations for their use.
The real question is... was it an ethical set to use given the possibility of a non-target catch when coon activity is low?
There should also be a reminder that posting non-target catches is not allowed. This is the second one in a weeks time.

I commend him for doing the right thing and turning the fisher in as required.....a fisher isn't a non target catch, it's a furbearing critter ;D......we don't need people making posts or posting pictures of domestic incidentals or game animals (i.e. rabbits, squirrels, turkey's, etc.)

Thank you . I,m fairly new to the trapping game and believe that I'm doing everything to the states trapping laws.If I don't know something I will ask the dumb question.Just to make sure I'm legal.You guys on here are very helpful at answering questions.And I thank you all for that

Not a good thing in my opinion.Yes things happen and sometimes they can not be helped and most of us including myself have made them,but I dont think mistakes should be broadcasted over the internet.This is why the restictions are in place in the northern zone,next they could be here.I dont want to go after the poster as he says he is new,but I think this thread should have be deleted right away.

Even though the poster said he made a mistake BEFORE you posted... Figured with your experience, which you kindly shared, you would know how big your own traps are.. So I thought I would share the specs from the supply house website.. Just in case they were wrong, you could let them know.. Even I as a naive youngster, know where mine fall.. Just so I know if Mr Kinddecguy, doesn't know 5 3/4 (inches) is the legal limit.

Respectfully, Andy With all respect I think the set is ethical I am still taking mink in cubbys here in southern zone mink run all season so my traps are also.....
