If you are going down a paved road and you see a culvert that you would like to set are you able to........doesn't the county own so many feet off the edge of a paved road.....thanks eric

Town & county has a right away across property for the road. The land owner actually owns to the center of the road.

The town and country right of way is to allow them to perform the necessary road and ditch maintenance. It is only for that purpose for use by them. It doesn't make the land in the right of way public property.
However, on the DEC website it says: -You are allowed to set a trap in a culvert or ditch unless the property is posted or the landowner does not allow trapping.
But, how do you know if the property owner allows trapping without asking them?
Or you could just go ahead and assume that since there is no posted signs that you are allowed to use their property for whatever purpose and when they find out that someone is trapping on their land without asking, it looks bad for all of us.
I personally ask everyone then there is no question.
